Terms & Conditions of Sale

In these Terms and Conditions: “We” “Us” and “Our” refers to Wentwood Property Development Ltd T/A Wentwood Kitchens Ltd. The term “You”, “Customer” and “Client” refers to the purchaser of goods, or the user or viewer of our website. Please read our terms and conditions fully before placing your order. By placing your order, you are fully read, understood, and agree to our terms and conditions and all orders are fully bound by these. If you have any questions please contact us via email, phone or at the address set out below.

 

  1. Quotations
    • Full supply and installation service
      • We work on a fixed price quotation scheme. This means there are no hidden charges and prices and invoice will be raised as per your agreed quotation.
      • Prices are set only once drawings are approved. Should any details be amended or added after drawings are approved by either us or the client, the quotation and price is subject to change. We will provide clear updated pricing before we proceed with any changes and require written approval to proceed on this basis.
    • Supply only
      • All dimensional responsibility lies with the client.
      • Drawings (if agreed and not working from drawings provided) will be based on dimensions provided to us.
      • Manufacture, as per drawings provided or approved by the client and from approval, shall be the sole responsibility of the client and we take no responsibility should there be any discrepancies due to inaccurate dimensioning.

 

  1. Initial FOC consultation service
    • We value clarity and transparency with all of our clients and provide an initial consultation, proposal and estimate free of charge for all prospective clients. Included within this service are the following:
      • Initial consultation via telephone or at our showroom. We will gather information on your preferences, wishes and ideas for your project and request you to forward a sketch/dimensions of your space prior to this, which we use to put together our initial proposal and estimate.
      • Initial proposal to included room plan and where possible sketches and or renders. A detailed package estimate will be provided alongside your proposal.
      • Follow-up meetings can be provided at our showroom/workshop if our proposal is of interest. This meeting will be up to 1hour.
      • Any additional meetings requested, prior to confirming your project and deposit paid, will be charged at £45 + vat per hour.

 

  1. Payment Terms
    • Full supply and installation service
      • A 5% deposit (up to maximum £500) will be taken of the initial quoted price to proceed with your order and once deposit is received your project will be confirmed in our schedule and an estimate installation advised.
      • Approximately 2-4 weeks prior to your manufacture slot, we will then organise and conduct a full site survey and meeting with client to discuss all detailing and specification.
      • Full construction drawings are then produced based on this meeting for your approval, along with a final quotation whereby a second installment will be due to total 80% of the total price; inclusive of deposit payment. This progresses your project into manufacture.
      • We take all dimensional responsibility.
      • The remaining 20%, plus any additional items added, will be due on the final day of installation.
      • Clients can make amendments to construction drawings, with up to three draft revisions produced. Any further drafts required may incur charges at our sole discretion.
      • Included in the price are up to two site visits for local projects, or one site survey for nationwide projects.
        • Any further site visits required may incur charges at our sole discretion.
      • Supply only
        • Payment is required upfront and in full at the time of approval of drawings and prior to any commencement of purchasing of materials or physical manufacturing of the project.
      • Finance
        • We offer access to finance options through Ideal4Finance.
        • Payment is required upfront and in full for all goods and services purchased using finance prior to any commencement of purchasing of materials or physical manufacturing.

 

  1. Your Cancellation Rights
    • All of our products are bespoke and made to measure. The design and planning of your project begins immediately after drawings have been approved.
    • Should you wish to cancel your order you must notify us in writing prior to your order being submitted to production; this the same point of payment of the second installment.
      • The payment of 5% deposit shall be retained to cover the costs of admin, planning and design work already completed.
    • Once your project and drawings have been signed off and second installment paid, no refunds will be possible.

 

  1. Our Cancellation Rights
    • If you commit a serious breach of these terms which is not remedied within 21 days of receiving notice from us, we may cancel any work in relation to your project immediately on written notice.
    • If you fail to make payment on the due date we may cancel any work in relation to your project or suspend further deliveries to you on giving you 14 days written notice.
    • We may cancel any work or future deliveries in relation to your project if
      • You are or propose to become the subject of a bankruptcy petition or order, or you make or propose to make an arrangement or composition with your creditors.
      • Acting reasonably we have serious doubts as to your solvency
      • In the result upon your death or mental incapacity.
    • Should we cancel the contract under clauses 5.1, 5.2 or 5.3,
      • You will immediately pay any outstanding sums owed to us, along with any reasonable expenses incurred by us in performing all or part of the scope of works.
      • We may cancel any other scope of works made by us with you.
      • We have the right, on giving reasonable written notice, to enter the premises and remove any goods and materials which we deem to belong to us.
    • Our rights under these conditions do not prevent us from exercising any other rights to recover amounts due to us for goods delivered to date and any loss, damage, costs, expenses or liability that we have sustained.

 

  1. Site Surveys
    • We conduct site surveys as manufacture needs to be performed off of room specific dimensions from site. For precise measurements we require finished ceiling heights and wall to wall runs to avoid potential problems at installation.
      • In situations where any building works are being done, our site survey will need to be conducted once walls are plastered and flooring is in.
    • Should any other, or further work, be carried out post our site survey, and dimensions differ from point of survey and drawings provided, charges may be incurred for any works or re-manufacture required to rectify.
    • Should we arrange and attend site on the understanding that the site is at an appropriate stage for survey, and site is not ready, there may be charges incurred for the loss of an agreed appointment.

 

  1. Spray-painting and samples
    • We offer to match any RAL or high street branded colour to provide full flexibility.
      • We may request you to provide a sample depending on the brand chosen.
      • We can send off a physical sample to provide a colour match.
    • We don’t provide colour sample spray outs as standard, however, these can be requested at a cost of £100 per colour. Example spray outs can be seen in our showroom.
    • Our standard sheen level is 10%, alternative options are 20%, 30% and 40% on a request basis.
    • We don’t currently offer a gloss, high gloss or burnished spray-painted finish.
      • We can offer other options for alternative pre-finished materials to achieve this look.
    • All quotations are inclusive of a single colour spray-painted or hand painted finish.
      • Each additional colour will incur a 3% surcharge. (percentage based on Joinery package price).
      • Each additional finish type will incur a 3% surcharge. (percentage based on Joinery package price).

 

  1. Appliances
    • We are a proud Miele Partner, providing competitive prices on all Miele products.
      • Other brands to match budget or desires are available on request.
    • It is important for us to supply your appliances so that we can accurately integrate these into the design and manufacture processes.
    • We supply both integrated and freestanding appliance solutions.
    • As part of our appliance package offer, we agree to take all dimensional responsibility to incorporate your appliances into our cabinetry.
    • During installation we will integrate and/or install your selected appliance package. We will prepare them for their final connections to be completed by your electrician.
    • Delivery of your appliance package will be completely handled by us, and we will remove all packaging from site.
    • Should you decide not to take our appliance package and to source your own appliances please note the following:
      • Dimensional responsibility for the openings within cabinetry are your responsibility.
      • We require a full list of all make/model information of your appliances at the point of site survey. We will use best endeavors to source all information available from each manufacturer, but note this varies between manufacturers and as such we hold no liability in the quality of this information.
      • We will provide opening sizes and it will be your responsibility to ensure your appliances fit within our cabinetry. Specific drawings will be provided for your approval.
      • Any amendments required to cabinetry to accommodate appliances post drawing approval sign off will be charged.
      • Installation of own sourced appliances will be considered out of the scope of our works and will be your responsibility.
      • Any doors or fascias will be supplied loose to be fitted by your 3rd party supplier.
      • Any damages incurred to any element supplied and fitted by us during the installation of your own supplied appliances will not be considered as our responsibility to fix or make good.

 

  1. Timescales
    • Timescales are dependent on style and size of your project and associated elements.
    • An estimated lead time can be provided on request with initial estimate but we cannot guarantee manufacture lead times until after your order is placed; on receipt of 80% payment following drawing approval.
    • A mutually convenient installation start date is decided between us and you, once manufacture is underway.
    • Lead-time given is for manufacture only and installation may not begin the next working day after completion.
    • We will use best endeavors to accommodate your preferred installation timescales and dates, however, all installations are subject to our live schedule.
    • Should there be building works completed prior to project installation, we can be flexible to any delays that may occur. However,
      • Installation will need to occur within 3 weeks from completion of manufacture or you may incur storage costs.
      • Alternatively delivery will be made to site for you to store and we will return to install once the site is ready.
        • Another payment may be required at this point prior to delivery.
      • For non-local clients, should you delay the delivery or installation of your project and associated elements once installation has been agreed, any losses may be passed on to you should we be unable to cancel travel related expenses already incurred or processed.

 

  1. Installations
    • For the duration of our installation, we require the room to be available to us and our installers only, with no other trades working in the area.
      • Should other trades be required to occupy the same space these parameters need to be prearranged and agreed in advance by both parties.
    • All personal items and other furniture should be removed from the room allowing a clear space for installation.
    • Removal of existing kitchen or area, followed by any building work, first and second fix electrical and plumbing, plastering, first coat wall paint and flooring should all be completed prior to us attending to install your project.

 

  1. Liability
    • Timber
      • Timber is a natural product. All timber has a wide variety of colouring and grain.
      • All timber reacts differently when cut. When undertaking work on your project items, you accept that unforeseen variations in the timber may result in minor breakouts or machine marks. To minimize any possible effects of this, we may at our discretion, choose to modify or amend any cutouts or sizes to best deal with the situation. We may use filler in order to repair such damage.
      • While we go to great lengths to ensure timber is dried correctly movement in solid timber cannot be prevented.
      • You accept that any variations in density and hardness of timber are a natural part of the product, and not the fault of us.
      • All timber components will be installed straight, flat and level for you to sign off installation.
      • Timber is a natural product and will move and change over time. You agree that you understand and accept this. We cannot be held accountable for the movement and change over time of any of our timber products.
    • Worktops – Solid Surface
      • Darker colours show scratches and marks more easily and should be treated with extra care. Whilst every effort to achieve a seamless join is made, We do not guarantee that you will not be able to see the join, due to variations in worktops adhesive and colour variations.
    • Worktops – Timber
      • To make best use of the timber, there may be larger flaws on the underside of the worktop, including manufacturing defects. These do not constitute a faulty product.
      • You accept there may be some natural flaws such as small knots and hairline cracks, which do not affect the performance of the worktop and do not constitute as a fault or damage.
      • You accept and understand that timber is a natural product and will move and change over time. We are not liable for the movement and change over time of any of our timber products.
    • Worktops – Customer supplied
      • Any templating for worktops and splash backs provided by alternative suppliers should be booked for after the kitchen is fully installed.
    • Worktops – General
      • To prevent damage from hot objects, always use heat resistant mats or trivets on the surface of the worktop.
      • Always use a chopping board for preparing food.
      • Wipe spilt liquids away with damp cloth.
      • Dried on residues can be removed with a mild abrasive domestic cleaner. Rub gently, rinse and wipe dry.
      • Cleaning with a sponge, water and mild detergent liquid is sufficient for normal maintenance.
    • Any damages or faults should be reported on installation, excluding and not limited to small snags, prior to signing off your installation. Any snagged items need to be reported within seven days of installation whereby an appointment will be made to return to rectify.
      • If we do not receive any such written notification, we will deem to have properly performed our obligations under the contract.
      • Snagging items will be addressed at our own expense. Snagging items do not constitute an incomplete installation and completion of your project. Therefore, these do not permit you from withholding payment until these are resolved.
    • We will not be liable for any loss, damage, costs, expenses or liability incurred post sign off of the project.
    • We will not be liable to you for any defects in the goods brought about by your failure to properly store the goods in accordance with clause 9.6.2.
    • We will not be responsible for loss of or damage to the goods arising from fair wear and tear, willful damage caused by you or any third party, accident or negligence by you or any third party, use of the goods other than as recommended by us, failure to follow our instructions, or alteration or repair carried out without our approval.
    • Our liability for defective goods will be limited at your option to replacing the goods, or rectifying such defects at our own expense provided that you give us full facilities all at reasonable times to remedy such defects.
    • Nothing in the conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, under section 2(3) of the Consumer Protection Act 1987 or for any other liability that cannot be restricted by law.

 

  1. Intellectual Property
    • We are the owner or the licensee of all intellectual property rights in the material produced in relation to any project or scope of works.
    • Unless otherwise stated, the copyright and other intellectual property rights for all material produced in relation to any project, including without limitation photographs and graphical images, are owned by us or our licencors.
      • Any use of this material whether in part or full, if not previously agreed, is prohibited.
    • Any rights not expressly granted in these terms are reserved.

 

  1. General
    • We reserve the right to photograph projects, throughout the phases of the scope of works and after completion.
      • Any and all photographs and information will be retained as per our privacy and GDPR policies, and in accordance with any bounds put on us by government.
    • We are not liable to you for any delay or failure to perform our obligations under the contract if it is due to an event beyond our reasonable control.
    • If a court finds any part of these conditions void or unenforceable, that clause or part will be deleted and the remaining provisions will continue to apply in full.
    • If we do not fully exercise one or more of our rights under these conditions, this does not prevent us from exercising any other rights in the future.
    • These terms are applicable to you and your project and are therefore personal. As such they cannot be transferred without prior written consent from our Directors, which will not be refused without good reason.
    • Unless we notify you otherwise, any notice to be given under these terms should be in writing addressed to us at the address below. We will send any notices to you to the address shown in the documents forming your project documents.
    • No party except you or us may exercise any rights in respect of these terms under the Contracts (Rights of Third Parties) Act 1999 (as may be amended or extended).
    • These terms and conditions are governed by English Law and both you and us submit to the exclusive jurisdiction of the Courts of England and Wales. “We/Us/Our” means Wentwood Property Development Ltd. Company No 08423072 whose registered office address is 23-24 Haverscroft Industrial Estate, New Road, Attleborough, Norfolk, NR17 1YE.
